1. General
These Terms & Conditions govern your use of aertexsports.com and any purchase of products from Aertex Sports ("we", "our", "us"). By using this website or placing an order with us, you agree to these terms.
2. Quotations Are Not Fixed Offers
All products on this website are sold on a quotation basis. Product listings are invitations to request a quote and do not constitute binding offers. A sale is formed only when we issue a written proforma invoice or order confirmation and any required deposit has been received. Quotation prices are valid for the period stated in the quotation.
3. Orders and Acceptance
Orders are confirmed by our written confirmation or proforma invoice. We reserve the right to decline any order. Custom, OEM, or personalized orders cannot be cancelled or modified once production has begun.
4. Payment Terms
Payment terms, including deposits and accepted payment methods, are as agreed in the quotation or proforma invoice. Goods remain our property until paid for in full.
5. Production and Lead Times
Any stated lead times are good-faith estimates and not guarantees. We are not liable for delays caused by events beyond our reasonable control.
6. Shipping and Delivery
Shipping terms, including Incoterms and responsibility for freight, are as agreed in the quotation or proforma invoice. Risk in the goods transfers according to the agreed terms. Unless stated otherwise, shipping costs, duties, and taxes are the buyer’s responsibility.
7. Inspection and Claims
Please inspect the goods promptly upon receipt. Any claim for damage, shortage, or defect must be notified to us in writing within 7 days of delivery, with supporting photographs. Claims made after this period may not be accepted.
8. Custom Products and Intellectual Property
For custom or OEM orders, you warrant that any logos, designs, or trademarks you supply do not infringe any third-party rights, and you agree to indemnify us against any claims arising from their use.
9. Product Use
Our sports equipment should be used as intended and in accordance with applicable safety standards and sport regulations. Appropriate supervision is recommended where applicable.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from the sale of goods is limited to the value of the goods in question. We shall not be liable for any indirect, incidental, or consequential losses.
11. Force Majeure
We shall not be responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, wars, strikes, or government actions.
12. Governing Law
These terms are governed by the laws of Pakistan. Any dispute shall first be addressed through good-faith negotiation between the parties.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. The version posted on this page at the time of your order shall apply.
